I am committed to providing a quality website to you and this policy outlines my ongoing obligations to you in respect of how I manage your Personal Information. I operate www.zorajanekerr.com.au (“the site”) and am the creator of The Vessel of Argeus (“the game”).
If you choose to use the site then you agree to the collection and use of information in relation with this policy. The Personal Information that the site collects is used for providing and improving the site and the game. I will not use or share your information with anyone except as described in this Privacy Policy.
I have adopted the Australian Privacy Principles (APPs) contained in the Privacy Act 1988 (Cth) (the Privacy Act). The APPs govern the way in which I collect, use, disclose, store, secure and dispose of your Personal Information.

Personal Information is information or an opinion that identifies an individual. Examples of Personal Information we may collect include: names, addresses, email addresses, phone and facsimile numbers. Some Personal Information (location data and device information) is collected automatically by the site - all other personal information collected and/or stored must be voluntarily authorised by you. The data the site collects automatically cannot identify you on its own.
Personal Information is obtained in many ways, subject to the relationship between you and I, and may include interviews, correspondence by telephone or facsimile, by email, via the site, from your website, from media and publications, from other publicly available sources, from cookies, and from third parties. I don’t guarantee website links or the policies of authorised third parties.
I collect your Personal Information for the primary purpose of providing the site and the game to you, and marketing. My services principally include, but are not limited to, commercial videogames developed by me, as well as the prototyping and playtesting of those games. I may also use your Personal Information for secondary purposes closely related to the primary purpose, in circumstances where you would reasonably expect such use or disclosure. You may unsubscribe from my mailing/marketing lists at any time by contacting me in writing, or using the automated unsubscription function contained in my emails.
When I collect Personal Information I will, where appropriate and where possible, explain to you why I am collecting the information and how I plan to use it. Personal Information collected by me may be held in hardcopy format, or electronic format stored on my computing equipment or on third party servers. If I receive unsolicited Personal Information, and I have no lawful basis on which to retain the information, I will destroy that information or ensure that it is de-identified.

Sensitive information is defined in the Privacy Act to include information or opinion about such things as an individual's racial or ethnic origin, political opinions, membership of a political association, religious or philosophical beliefs, membership of a trade union or other professional body, criminal record or health information.
Sensitive information will be used by me only:
• For the primary purpose for which it was obtained.
• For a secondary purpose that is directly related to the primary purpose.
• With your consent; or where required or authorised by law.

Where reasonable and practicable to do so, I will collect your Personal Information only from you. However, in some circumstances I may be provided with information by third parties. In such a case I will take reasonable steps to ensure that you are made aware of the information provided to me by the third party.
I may employ third-party companies and individuals due to the following reasons:

• To provide services on my behalf;
• To perform service-related services; or
• To assist me in analysing how my services are used.
I want to inform our service users that these third parties have access to your Personal Information. The reason is to perform the tasks assigned to them on my behalf. However, they are obligated not to disclose or use the information for any other purpose.
I use Squarespace’s services to collect and analyse data and information, and you should familiarise yourself with their privacy policy as well.

'Cookies' are small pieces of information that are stored by the browser on your computer's hard drive. The data collected about your use of the site is transmitted to and stored on Squarespace’s servers. Squarespace uses this data for the purpose of compiling usage reports for me and providing other services relating to website activity and internet usage.
The reports provided by Squarespace to me contain only aggregate non-personal data about your use of these websites and online facilities. These reports may contain data relating to pages viewed, files downloaded or the completion of online forms or subscriptions. I use the data collected by Squarespace to improve the site and the game and to help me understand how people are using them.
Squarespace may transfer this data to third parties where required to do so by law, or where third parties process this data on Squarespace behalf.
You may refuse the use of cookies by selecting the appropriate settings on your browser. Please note that if you do this, you may not be able to use the full functionality of the site and online facilities. By using these websites and online facilities, you consent to the processing of data about you by Squarespace in the manner and for the purposes set out above.

However, most of the Personal Information is, or will be, stored in client files which will be kept by us for a minimum of 7 years.

You may access the Personal Information I hold about you and update and/or correct it, subject to certain exceptions. If you wish to access your Personal Information, please contact me in writing. Due to the anonymous nature of much of the data collected, I may not be able to supply you with specific data pertaining to you immediately.
I will not charge any fee for your access request but may charge an administrative fee for providing a copy of your Personal Information which is consistent with the effort required to provide it.
In order to protect your Personal Information I may require identification from you before releasing the requested information.

I will not knowingly solicit data from, or market to, children under the age of 16. If a parent or guardian becomes aware that his or her child has provided us with information without their consent, the parent or guardian should contact me in writing through my contact form. I will delete such information from my files within a reasonable time.
